End User License Agreement
The rules for using The Sky Decides and its launcher. Plain terms, no traps.

This End User License Agreement (the “Agreement”) is a legal agreement between you and Tidepool Studios (“we”, “us”) covering The Sky Decides and the launcher used to install, activate, and update it (together, the “Software”). By installing, activating, or playing the Software, you agree to these terms. If you do not agree, do not install or use the Software.
When you buy a license key for The Sky Decides, we grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Software for your own private, non-commercial use. You may install and activate it on the devices you own and use, subject to the activation limits tied to your key.
You are buying a license to play the game, not the game itself. We and our licensors keep all ownership of the Software, including its code, art, audio, characters, and branding, and all intellectual property rights in it. Nothing here transfers those rights to you.
- 01Install and play the Software on devices you own, within your key’s activation limit.
- 02Create mods, custom species, scenarios, and minigames using the in-game tools, and share them through the channels we provide.
- 03Capture and share screenshots and video of your playthroughs, including on monetized channels, as long as it is your own gameplay and not a repackaging of the Software.
- 01Copy, sell, rent, lease, sublicense, or redistribute the Software or the launcher, or otherwise make them available to others.
- 02Sell, share, or transfer your license key, or resell access to the Software.
- 03Reverse-engineer, decompile, or disassemble the Software, except to the extent the law expressly permits despite this restriction.
- 04Circumvent, disable, or tamper with the license, activation, or update systems, or use the Software with tools designed to defeat them.
- 05Use the Software or its assets to build a competing product, or use them commercially beyond the sharing rights described above.
The Software is activated with a license key and checks that activation from time to time. A key may be revoked if it was obtained fraudulently, charged back, refunded, or used in breach of this Agreement, and the Software will no longer activate with a revoked key. Refunds and the revocation that comes with them are governed by our Refund Policy.
You keep ownership of the original mods, species, scenarios, and minigames you make. When you publish that content through our services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute it so other players can find and use it, and to run the leaderboards and features that go with it.
You are responsible for what you publish. Do not upload content that is illegal, infringes someone else’s rights, or is designed to harm other players or their systems. We may remove published content that breaks these rules.
The launcher may download and install updates to the Software, including bug fixes, balance changes, and new content. Those updates are part of the Software and are covered by this Agreement. We may change, add, or remove features over the life of the game.
This license lasts until it ends. It ends automatically if you break the terms of this Agreement, and it ends if your key is revoked under the Refund Policy. When the license ends you must stop using the Software and remove your installations. The sections that by their nature should survive termination — ownership, restrictions, disclaimers, and liability — continue to apply.
The Software is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every device. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to the Software. Our total liability for any claim relating to the Software will not exceed the amount you paid for your license. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
This Agreement is governed by the laws of the jurisdiction in which Tidepool Studios is established, without regard to its conflict-of-laws rules. This does not affect any mandatory consumer-protection rights you have where you live — where local law gives you more than this Agreement, the law wins.
We may update this Agreement as the game evolves. When we do, we will update the date at the top of this page, and your continued use of the Software after a change means you accept the updated terms.
